Last month, Hodgkinson Street Mepham, LLC expertly defended an OB/GYN doctor in a wrongful death case regarding a stillbirth that occurred in 2009, in which the doctor was accused of negligence.
On December 9, 2009, the plaintiff arrived at the hospital in labor and was hooked up to a fetal heart monitor. She labored for about 15 hours, without complication, before the fetal heart monitor indicated signs of distress. She was immediately taken for an emergency cesarean section. The baby was born without a heartbeat and was not breathing. Doctors attempted resuscitation but were unable to save the baby.
The plaintiff alleged that her baby had suffered hypoxia, or suffocation in the uterus, and that had a cesarean section been done earlier, her baby would not have died. She also alleged that the doctor violated the duty of informed consent by not informing her of various risks alleged to…

Last month, Hodgkinson Street Mepham (HSM) tried an interesting and complex case. In Pierce County, Washington, HSM attorneys Jeff Street and Abby Miller took on a “wrongful life” claim to trial (Pierce Co. Superior Court 14-2-09199-6). This type of claim is not valid in most states, which made for an interesting trial.
The defendants in this case include HSM’s client, a neurologist, as well as a co-defendant, an obstetrician. In the course of his practice, HSM’s neurologist client cared for a young epileptic woman. Following an allegedly incomplete informed consent discussion, the neurologist prescribed an anti-seizure medication. The anti-seizure medication in question is known to increase the risk of birth defects in expectant mothers. The patient later became pregnant, and delivered a child with birth defects related to the anti-seizure medication.

The first major win of 2015 came in February. In Multnomah County, HSM attorneys David Mepham and Abby Miller expertly defended their client, an OBGYN (Multnomah County Court 1306-08953). According to the court documents, the plaintiff alleged the defendant prescribed a medication that lowered the plaintiff’s seizure threshold. The plaintiff further alleged she experienced a seizure while driving, and subsequently sued her neurologist, OBGYN, and pharmacist for damages. The jury returned a unanimous defense verdict.
